James McKeever Heirs to Andrew Lewis Roger

In this entry, on 1 Sep 1810, William McKeever, one of the heirs of James McKeever dec'd, agrees to deed the land his father obtained from Adam Shepherd to Andrew Lewis Roger. Mention is made of the construction a race on the river.

Then on 23 May 1811, McKeever, with a power of attorney from the other heirs, formally transferred the land to A. L. Roger, as shown below.

According to verbal consent given to me by my brothers, sisters, and mother and Louis Valcourt, executor and administrator for the heirs of my father now deceased, I have this day sold, bargained, aliened and transferred to Andrew Lewis Roger all that tract of land situated on Salt River adjoining the town of Shepherdsville in Bullitt County, Kentucky containing one hundred and fifty acres belonging to my father, now deceased, for him the said A. L. Roger, his heirs, executors and administrators to enjoy and possess forever free from every tax except those which are to begin from the date herein mentioned. I warrant the said property free from any mortgage, interposition or impeachment whatsoever, and I will be answerable in my own name and the names of my brothers, sisters, mother and said Louis Valcourt for any trouble, opposition or impediment to his full and peaceful taking possession of and enjoying it forever as aforesaid. In consideration of that land the said A. L. Roger has this day delivered into my hand a parcel of goods of my own choice amounting to thirteen hundred and forty four dollars and eighty eight cents and half out of which the sum of one thousand dollars is to pay for the said tract of land, and the above I will make him my note at 6 months from the date of the presents, that is to say if on or before the first of April, 1811, the said tract of land is transferred or conveyed to A. L. Roger, his heirs, executors or administrators, and by a consent to be given from all the parties concerned in the said tract of land, then the note of one thousand dollars is to be returned to me and to be considered void and null, and of which the said A. L. Roger doth by this presents agree not to dispose of the said note of $1000 until after the expiration of the time above mentioned on my not fulfilling my engagements in giving him the consent of my sale to him of all persons concerned in said property, it has been further agreed that in digging the race for the mill the said A. L. Roger or his agent intend to establish on the place if he or they find no rocks that he or they should be obliged to have blown up to follow the level course of the race, then he the said A. L. Roger will pay over and above the said sum of $1000 above mentioned the sum of $400 which will be paid to me or some other person duly and legally authorized to receive the same. I further engage myself of the heirs, executors and administrators of my father dec'd to give to the said A. L. Roger a good, full and warrantable title to the said land above mentioned at their or my own expense for which land we will grant to A. L. Roger, his heirs, executors ro administrators all the privileges and advantage which were given to my father in the deed given to him by Adam Shepherd, bearing date of 17 May 1805 as mentioned in the act recorded at Shepherdsville the __

It is further agreed that my consent is entirely given to the said A. L. Roger for the share of the said tract of land coming to my share as heir of my father for which in case it would be out of my power to fulfill this engagement, my share will belong to him, deducting the amount of it out of the $1000 I shall have to pay him. To which agreement we both have put our hands and seals binding ourselves, our heirs, executors and administrators to the whole fulfilling of it. Done at Shippingport the first day of September 1810. Whereas I William McKeever who am empowered by the heirs of the within mentioned James McKeever who is deceased to sell, dispose and transfer the within mentioned tract of land by a power of attorney for a valuable consideration, do hereby transfer all the right of the said heirs of the within mentioned James McKeever to A. L. Roger, his assigns, heirs and defending against said heirs of McKeever and all person or persons claiming the same. Witness my hand and seal this 23rd day of May 1811. (signed) William McKeever
