Thomas Phillips to Joseph Brooks, 1785

Thomas Phillips patented 400 acres [link] in present-day north-central Bullitt County, and sold it to Joseph Brooks, as shown in the transcript and image shown below.

Thomas Phillips to Joseph Brooks; 400 acres; 1 Nov 1785

This indenture made this first day of November in the year one thousand seven hundred and eighty five between Thomas Phillips of Nelson County and State of Virginia of the one part and Joseph Brooks of Jefferson County and State aforesaid of the other part. Witnesseth that the said Thomas Phillips for and in consideration of the sum of two hundred pounds current money of said state to him in hand paid by the said Joseph Brooks, the receipt whereof he doth hereby acknowledge and thereof doth release and discharge the said Joseph Brooks, his heirs and assigns forever, he the said Thomas Phillips hath this da granted bargained and sold, aliened, released and confirmed and by these presents doth grant, bargain and sell, alien, release and confirm unto the said Joseph Brooks, his heirs and assigns forever, a certain parcel of land situate in the county aforesaid containing four hundred acres more or less, lying and being on the waters of Floyds Fork, bounded as followeth viz. Beginning at a beech, two hickories and a black oak about one hundred poles from the Salt River trace on the west side and about six miles north of Bullitts Lick, thence North six degrees East three hundred and twenty poles to a Spanish oak, and sundry other trees in a flat, thence East two hundred and two poles to a large hickory in a green briar thicket, thence South six degrees West three hundred and twenty poles to three sugar trees & a walnut on the side of a ridge on the south side of a creek, thence West two hundred and two poles to the beginning, with the appurtenances thereunto belonging or in any wise appertaining and the reversion and reversions, remainder and remainders, rents, issues, and profits thereof and every part thereof.

To have and to hold the four hundred acres of land aforesaid and appurtenances as may be more fully understood by a reference had to a patent granted the said Thomas Phillips dated 27th January 1784 which said patent is before the ensealing hereof delivered the said Joseph Brooks by the said Thomas Phillips unto the said Joseph Brooks, his heirs & assigns forever, to the only proper use, benefit and behoof of him the said Joseph Brooks and of his heirs and assigns forever, and to and for no other use, interest or purpose whatsoever, and the said Thomas Phillips doth hereby covenant & agree to and with the said Joseph Brooks and his heirs and assigns that he will at all times hereafter, when he shall be thereto required, give any other further assurance or conveyance that shall be necessary to secure the four hundred acres of land aforesaid and appurtenances unto the said Joseph Brooks and his heirs and assigns forever, and doth hereby warrant & forever defend the four hundred acres of land aforesaid with the appurtenances unto the said Joseph Brooks, his heirs & assigns forever, from the claim of all and every person or persons claiming by, from or under his or his heirs forever.
