Richard Simmons to Brittain White, 175 Acres

Richard Simmons obtained 1000 acres between Salt River and Floyd's Fork from the surveys of Marsham Brashear, and sold parts of it to several people including this part to Brittain White. At the time, this was still part of Jefferson County.

Jefferson County Deed Book 4, pages 180-2

This indenture made this sixth day of January in the year of our Lord 1795 between Richard Simmons and his wife Tabitha Simmons of Nelson County and state of Kentucky of the one part and Brittain White of the county of Jefferson and state as aforesaid of the other part. Witnesseth that the said Richard Simmons and his wife Tabatha Simmons for and in consideration of the sum of 150 pounds to them in hand paid, the receipt whereof they do acknowledge and confess, hath given, granted, bargained and sold and by these presents do give, grant, bargain and sell unto the said Brittain White, his heirs and assigns 175 acres of land situated and lying in Jefferson County, lying between Salt River and Floyd's Fork, being part of Marsham Brashear's settlement and preemption. Beginning at the lower corner of Levy Simmon's survey on the bank of Salt River at three elms and beech trees, thence North 15° East 160 poles to two elms standing in Levy Simmons' line, thence North 75° West 119 poles to two beech trees, thence South 15° West 294 poles to a sugar tree and beech on the bank of Salt River, thence up Salt River with its meanders to the first beginning. To have and to hold the said 175 acres of land with all and singular the appurtenances thereunto belonging or in any wise appertaining or belonging unto the said Brittain White, his heirs and assigns to the only proper use, benefit and behoof of him the said Brittain White, his heirs and assigns forever against the said Richard Simmons and his wife Tabitha Simmons & they do hereby confess and acknowledge that they are seized of an absolute indefesable estate of inheritance in the said 175 acres of land and that they will warrant forever defend the same unto the said Brittain White, his heirs and assigns against the claims of him the said Richard Simmons and his wife Tabitha Simmons and every person or persons whatsoever. In witness whereof the said Richard Simmons and his wife Tabitha Simmons hath set their hands and seals the day and year above written. (signed) Richard Simmons.

At a court held for Jefferson County, January 6th 1795. This deed of bargain and sale from Richard Simmons and Tabitha his wife to Brittain White was acknowledged by the said Richard Simmons and ordered to be recorded. Teste. Stephen Ormsby, Clerk.
