Thomas Whitledge to Stephen Hilton - 50 Acres

On 12 Nov 1790, Phillip Spiller of Virginia, by his attorney in fact William King, sold his 250 acre tract located on the waters of the West Fork of Cox's Creek to Thomas Whitledge who was then living in Bourbon County. The following July, Whitledge divided it up and sold parts to Thompson Overall, William Overall, and Stephen Hilton. The deed to Stephen Hilton is transcribed below.

This indenture made this 15th day of July in the year of our Lord 1791 between Thomas Whitledge of the county of Bourbon and state of Virginia of the one part and Stephen Hilton of the county of Nelson and district of Kentucky of the other part. Witnesseth that for and in consideration of the sum of 25 pounds to him in hand paid by the said Stephen Hilton, the receipt whereof he doth hereby acknowledge he the said Thomas Whitledge hath granted, bargained, sold, aliened and confirmed and by these presents doth grant, bargain, sell, alien and confirm unto the said Stephen Hilton and his heirs forever a certain tract of land or parcel of land containing 50 acres, being part of 250 acres that said Whitledge bought of Philip Spiller lying and being in the county of Nelson and District of Kentucky on the west fork of Cox's Creek and bounded as followeth, viz. Beginning at a beech and sugar sapling and hickory near a small run, thence North 17° West 86 poles to a beech marked T.O. and S.H. on a ridge, thence North 70° East 92 poles to a white oak standing on a side of a hill, thence South 20° East 86 poles to a walnut tree in a glade, thence South 73° West 94 poles to the beginning and all the estate, right, title and interest of him the said Thomas Whitledge in and to the said premises to have and to hold the said 50 acres of land with the appurtenances unto him the said Stephen Hilton, his heirs and assigns forever and the said Thomas Whitledge for himself and his heirs doth hereby warrant and defend the said 50 acres of land with every of its appurtenance unto him the said Stephen Hilton, his heirs, executors, administrators or assigns against himself, his heirs and all persons whatsoever. In witness whereof the said Thomas Whitledge hath set his hand and affixed his seal the day and year above written. Signed, sealed, acknowledged and delivered in the presence of Caleb Wise, John Frad, William Overall. (signed) Thomas Whitledge.

At a court begun and held for Nelson county on Tuesday, the 10th day of January 1792, this deed from Thomas Whitledge to Stephen Hilton for 50 acres of land was proved by the oaths of Caleb Wise and William Overall, two of the subscribing witnesses thereto and ordered to be recorded.
